1. Introduction
Welcome to Jamalek ("we," "our," or "us"). These Terms and Conditions ("Terms") govern your use of the Jamalek platform, website, mobile application, and related services (collectively, the "Platform"). Jamalek operates as a technology platform that connects customers seeking beauty services ("Customers") with independent beauty service providers ("Experts").
By accessing or using our Platform, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use the Platform.
2. Platform Role
Jamalek is a marketplace platform that facilitates connections between Customers and Experts. We are not:
- An employer of Experts (they are independent contractors)
- A provider of beauty services
- Responsible for the quality of services provided by Experts
- Liable for any issues arising from the service delivery between Customers and Experts
We act solely as an intermediary, providing technology and payment processing services to facilitate bookings.
3. Account Registration
3.1 For Customers
To book services, Customers must provide accurate information including phone number, email, and location. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
3.2 For Experts
Experts must complete an application process and receive approval before offering services on the Platform. Approved Experts must maintain accurate profile information, including portfolio images, working hours, and service offerings. Experts are responsible for their own compliance with local business regulations, licenses, and tax obligations.
4. Booking Services
4.1 Booking Process
Customers can book single services or group bookings (up to 10 guests). Booking availability is subject to Expert availability and is confirmed upon Expert acceptance. We reserve the right to refuse or cancel any booking at our sole discretion.
4.2 Service Locations
Services are typically provided at the Customer's specified location. Customers must ensure that the location is safe, accessible, and suitable for the requested services. Experts reserve the right to refuse service at unsafe or unsuitable locations.
4.3 Service Modifications
Any modifications to bookings (date, time, location, number of guests) must be requested through the Platform and are subject to Expert availability and approval. Modification fees may apply.
5. Pricing and Payment
5.1 Pricing
Service prices are set by Experts and displayed on the Platform. Prices may vary based on service type, price tier (100-600 QAR, 700-900 QAR, 1000+ QAR), number of guests, and location. All prices are in Qatari Riyals (QAR) unless otherwise stated.
5.2 Deposit
A non-refundable deposit of 20% of the total service price is required at the time of booking to secure your appointment. This deposit is deducted from the final payment.
5.3 Payment Methods
We accept payment through our secure payment gateway. Payment information is processed securely and in accordance with applicable payment card industry standards.
5.4 Wallet Credits
Refunds and credits may be added to your Jamalek wallet. Wallet credits can be used for future bookings but are non-transferable and cannot be exchanged for cash. Wallet credits expire after 12 months of inactivity.
6. Cancellation and Refunds
6.1 Customer Cancellations
- More than 48 hours before service: Full refund (minus deposit) to wallet credit
- 24-48 hours before service: 50% refund to wallet credit
- Less than 24 hours before service: No refund (deposit forfeited)
- No-show: No refund, full payment charged
6.2 Expert Cancellations
If an Expert cancels a confirmed booking, Customers will receive a full refund including deposit, or we will assist in finding a replacement Expert if available.
6.3 Refund Processing
All refunds are processed to the Customer's Jamalek wallet unless otherwise specified. Refunds to original payment methods may take 5-10 business days. Wallet refunds are instant.
7. Expert Responsibilities
- Provide services in a professional, timely, and safe manner
- Arrive at the scheduled location on time
- Bring all necessary equipment and supplies
- Maintain appropriate licenses, certifications, and insurance as required by local laws
- Comply with health and safety standards
- Respect Customer privacy and property
- Respond to Customer inquiries and booking requests promptly
- Update availability calendar in real-time
7.1 Platform Exclusivity and Anti-Circumvention
CRITICAL: Experts are strictly prohibited from circumventing the Platform to avoid payment of fees or commissions. This includes, but is not limited to:
- Soliciting Off-Platform Bookings: Directly or indirectly encouraging Customers to book services outside of the Jamalek Platform, including during or after a Platform-facilitated service
- Contact Information Exchange: Requesting, sharing, or using Customer contact information (phone, email, social media) to arrange future bookings outside the Platform
- Direct Payment Requests: Asking Customers to pay directly to the Expert instead of through the Platform for services initiated through Jamalek
- Referral Schemes: Offering discounts or incentives to Customers to book directly, bypassing the Platform
- Re-booking Prevention: Any attempt to prevent Customers from re-booking through the Platform for future services
Agreement Period: These restrictions apply to all Customers that Experts first connected with through the Jamalek Platform, regardless of when the restriction is violated (during active Platform use or after).
Consequences of Violation: Violation of these terms will result in:
- Immediate termination of Expert account and removal from the Platform
- Forfeiture of all pending payments and wallet balances
- Payment of liquidated damages equal to 50% of all off-platform transaction amounts
- Legal action to recover damages, fees, and costs
- Permanent ban from the Platform
Exceptions: Experts may provide services to Customers they had existing relationships with prior to joining Jamalek, provided such relationships can be documented. However, Experts may not use the Platform to build a customer base and then move those customers off-platform.
8. Customer Responsibilities
- Provide accurate booking information (location, number of guests, service requirements)
- Ensure the service location is safe, accessible, and suitable
- Be present and available at the scheduled time
- Treat Experts with respect and professionalism
- Pay for services as agreed
- Cancel or modify bookings in a timely manner if needed
- Provide honest feedback and ratings
9. Ratings and Reviews
Customers may rate and review Experts after service completion. Reviews must be honest, accurate, and not contain defamatory, offensive, or discriminatory content. We reserve the right to remove reviews that violate our community guidelines.
10. Intellectual Property
All content on the Platform, including logos, text, graphics, and software, is the property of Jamalek or its licensors and is protected by copyright and trademark laws. Experts retain ownership of their portfolio images and content but grant Jamalek a license to display such content on the Platform.
11. Prohibited Activities
Users agree not to:
- Use the Platform for any illegal or unauthorized purpose
- Circumvent the Platform: Experts may not solicit, facilitate, or complete bookings outside the Platform with Customers they first connected with through Jamalek. All bookings must go through the Platform's payment system (see Section 7.1 for detailed anti-circumvention policy)
- Payment Bypass: Customers may not arrange direct payments with Experts to avoid Platform fees. All transactions must be processed through Jamalek
- Impersonate any person or entity
- Harass, abuse, or harm other users
- Interfere with or disrupt the Platform or servers
- Attempt to gain unauthorized access to any portion of the Platform
- Use automated systems to access the Platform without permission
- Collect or harvest information about other users for off-platform business purposes
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, JAMALEK DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. JAMALEK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM.
Jamalek's total liability for any claims arising from your use of the Platform shall not exceed the amount you paid to Jamalek in the 12 months preceding the claim.
Customers acknowledge that services are provided by independent Experts, and Jamalek is not responsible for the quality, safety, or outcome of services. Any disputes regarding service quality must be resolved directly with the Expert or through our customer support.
13. Dispute Resolution
In case of disputes between Customers and Experts, we encourage direct communication. If resolution cannot be reached, please contact our customer support team at info@jamalek.life or +974 5070 4077.
These Terms shall be governed by and construed in accordance with the laws of the State of Qatar. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Qatar.
14. Modifications to Terms
We reserve the right to modify these Terms at any time. Material changes will be notified to users via email or Platform notification. Continued use of the Platform after changes constitutes acceptance of the modified Terms.
15. Termination
We may suspend or terminate your access to the Platform at any time for violation of these Terms, fraudulent activity, or any other reason we deem necessary. Experts may be removed from the Platform for poor service quality, policy violations, or failure to maintain account standards.
